Summary

In AHV-Unternehmen findet eine „Aufbereitung“ von Öko-Zutaten im Sinne der EG-Öko-VO statt. Keine Anwendung findet die EG-Öko-VO, wenn es keinen „Käufer“ im Sinne des Artikel 2 der EG-Öko-VO gibt. Dies ist beispielsweise in den meisten Kindertagesstätten der Fall. Für die Kennzeichnung sind die Etikettierungsvorschriften des Artikels 5 (3) maßgeblich. Für die hausinterne Qualitätssicherung und die Überprüfung durch die Öko-Kontrollstellen gelten die Rechtsvorschriften des Artikel 8 Absatz 1, des Artikel 9 Absatz 7 und der „Mindestkontrollanforderungen“ des Anhang III „Allgemeine Vorschriften“ und der „Speziellen Vorschriften“, Teil B der EG-Öko-Verordnung.
Kriterien zur Einordnung von AHV-Betrieben in Kategorien sind insbesondere die Organisationsform inkl. Rechtsform und Einkaufsstruktur, das Verpflegungsangebot und der Abverkauf der Mahlzeiten sowie die Käuferstruktur.
Im Vergleich zu anderen Verarbeitungsunternehmen weisen Unternehmen der AHV folgende Besonderheiten auf: keine Etikettierung im üblichen Sinn sondern Kennzeichnung über Speiseplan, Speisekarte oder produktbegleitendes Werbematerial; häufig wechselndes Speisenangebot inkl. Rezepturen; mehrheitlich keine „Verarbeitungsprotokolle“ bzw. fest stehende Rezepturen; sehr unterschiedliche Angebotsformen von Bio-Produkten (von Öko-Aktion bis Öko-Festival).
Es wurde ein Standardkontrollkonzept mit Verfahrensanweisung entwickelt und als offenes Word-Dokument allen Kontrollstellen zur Verfügung gestellt. Im Hinblick auf das durch die Öko-Kontrollstellen durchzuführende externe Kontrollverfahren wird vorgeschlagen, dass Inspektionen in Unternehmen der AHV grundsätzlich unangekündigt durchgeführt werden, wobei das Hauptaugenmerk auf die in der Betriebsbeschreibung festgelegten Risikopunkte liegen sollte, da dort die materielle Öko-Qualität am stärksten gefährdet wird. Die Inspektion beginnt mit der Erfassung des Zukaufs von Öko-Zutaten. Wichtig sind eine korrekte Deklaration der bezogenen Zutaten, eine richtige Kennzeichnung auf Lieferscheinen und Rechnungen und ein Nachweis über die Konformität der Lieferanten mit den Anforderungen der EG-Öko-VO.
Der im Rahmen des Vorhabens erstellte Küchenleitfaden beinhaltet neben allgemeinen Grundlagen zum Ökologischen Landbau und den rechtlichen Rahmenbedingungen für die Verwendung und Auslobung von Bio-Produkten eine Übersicht über die Bedingungen und den Ablauf des Kontrollverfahrens sowie praktische Beispiele.


Summary translation

In foodservice enterprises a "processing" of organic ingredients in the sense of the EU Regulation 2092/91 takes place. No application of the EU Regulation 2092/91 is found if there is no "buyer" in the sense of article 2 of the EU Regulation 2092/91. This is, for example, the case in most day-care facilities for children in Germany. For labelling the labelling regulations of article 5 (3) are relevant. For in-house quality management and the inspection by organic certifiers legislation in article 8 paragraph 1, article 9 paragraph 7 and the "minimum control requirements" of appendix III "general regulations" and the "special regulations", part of B of the EU Regulation 2092/91 apply.
Criteria for the classification of foodservice enterprises into categories useful for organic certification are in particular the organizational form including the legal form and the purchasing structure, the food/product offer, the mode of selling of the meals/components as well as the buyer structure.
Compared with other processing enterprises foodservice enterprises exhibit the following characteristics: no labelling in the usual sense but rather labelling on a menu or product-accompanying advertising material; frequently changing food offer including the recipes; no "processing protocols" and/or fixed recipes by the majority of operations; highly varied forms of use of organic products (from organic specialty weeks to organic-festivals).
A standard control concept with instructions for procedure was developed and circulated as an open source MS-Word document to all organic certifying bodies in Germany. Regarding external inspection procedures to be accomplished by the organic certifiers it is suggested that inspections should be carried out unannounced. Special attention should be given to the points of risk identified in the operating description, since organic quality is most strongly endangered here. The inspection begins with the ascertainment of the purchase of organic products. The correct declaration of the obtained products is important as are a correct marking on delivery bills and invoices and a proof of supplier conformity with the requirements of the EU Regulation 2092/91.
A manual for foodservice operators was developed in the context of the project. Besides covering general principles on organic agriculture and the general legal framework for the use and labelling of organic products an overview of the conditions and the duration of validity of the inspection procedure as well as practical examples are given.
